Consent to the Transfer of Your Personal Data

Considering that:

  • โ€œALCOR-UKRAINEโ€ LLC, organized and existing under the laws of Ukraine, the address: 29 Cherniakhovskoho str., Kyiv, Ukraine, 04111, the email:ย dpo@alcor-bpo.com (โ€œAlcorโ€), provides recruitment, consulting and administrative services (โ€œServicesโ€) for customers via BPO HOLDING LLP, organized and existing under the laws of the United Kingdom,ย theย address: 61 Bridge Street, Kington, Herefordshire, HR5 3DJ, and/orย affiliates, associates and partnersย (โ€œBPOโ€),
  • Alcor acting as a controller with regard to my personal data, has collected and stored some personal data about me (as the data subject), based on its legitimate interest to render Services, that require gathering information about candidates, including me, concerning their qualification and skills in the information technology field, who then may provide services in the interests of one of the customers (communicated to me) mentioned in the Privacy Notice (available via the link: https://alcor-bpo.com/privacy-notice/), including all the parent companies, subsidiaries, affiliates, associates and partners (โ€œClientโ€),
  • My personal data, processed by Alcor, includes contact details (such as full name, physical address, email address, postal address, phone number, user IDs in messengers and telecommunication applications), information referring to my professional background (such as education data, professional experience, credentials, references, and skills, former or current job title, role, occupation, industry, employers and/or clients, participation in various projects), and any other non-sensitive personal data that could reasonably be collected by Alcor for the purpose specified above, or provided by me at my own intention and processed by Alcor for the same purpose,
  • Alcor ensures that at any given moment my personal data will be processed in compliance with the following Laws:
    • EU: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016;
    • Ukraine: Law of 1 June 2010 No. 2997-VI on Personal Data Protection;
    • US: Privacy Act of 1974, Virginia Consumer Data Protection Act, California Consumer Privacy Act (as amended by California Privacy Rights Act), Colorado Privacy Act, Utah Consumer Privacy Act, Connecticut Data Privacy Act, and other state data privacy Laws;
    • Argentina: Personal Data Protection Act, Act No. 25,326 of 2000 and Decree No. 1558/2001 Regulating Law No. 25.326, and its regulatory decrees, amended by Decree No. 1160/10;
    • Brazil: Law No. 13.709 of 14 August 2018, General Personal Data Protection Law (as amended by Law No. 13.853 of 8 July 2019);
    • Chile: Law No. 19.628 on the Protection of Private Life 1999;
    • Colombia: Statutory Law 1581 of 2012 (October 17) Which Issues General Provisions for the Protection of Personal Data and Decree 1377 of 2013 (June 27) Which Partially Regulates Law 1581 of 2012 and Decree 1074 of 2015;
    • Mexico: Federal Law on Protection of Personal Data Held by Private Parties as of 27 April 2010 and Regulations to the Federal Law on Protection of Personal Data Held by Private Parties and the Privacy Notice Guidelines;
    • Uruguay: Law No. 18.331 on the Protection of Personal Data and the Habeas Data Action 2008, Decree No. 414/009 Regulating Law 18.331 Relating to the Protection of Personal Data, and Decree No. 64/020 on the Regulation of Articles 37-40 of Law No. 19.670 of 15 October 2018;
    • Brazil: Law No. 13.709 of 14 August 2018, General Personal Data Protection Law (as amended by Law No. 13.853 of 8 July 2019).
  • Further consideration of me as the candidate and, upon successful completion of the selection process, cooperation with me requires transfer of my personal data to BPO, acting as a controller (or controllers) regarding my personal data, which will then reasonably need to share this data with the Client, acting as a controller with regard to my personal data, for the same purpose,
  • Given the Laws mentioned here above, I acknowledge that I have the right to demand from the controllers access to, correction and/or deletion of, and limitation of the processing of my personal data, as well as the right to portability of my personal data and, if applicable, the right to object against the processing my personal data, especially when it is based on the legitimate interest of the controller.
  • I acknowledge that I can contact either controller in relation to the processing of my personal data, and file any requests in this regard, at the addresses mentioned above,
  • if I consider that my personal data is processed in contradiction with legal regulations, I have the right to request remedial action from the controllers, or to file a complaint directly with the respective personal data protection authority, namely:

  • I acknowledge that Alcor shall archive this consent for the purpose of fulfilling the controllerโ€™s statutory obligation to be able to demonstrate that my consents to the processing have been given,
  • I hereby consent to the further transfer of my personal data to BPO and the Client, being aware and understanding that Alcor renders Services to the Client via BPO, and, consequently, transfer of my personal data shall be performed by Alcor via BPO to the Client, and upon successful completion of the selection process, I will provide services in favor of the Client.
